The United States Coast Guard (USCG), Base Miami Beach, intends to negotiate and award a firm-fixed-price purchase order on a sole source basis to Pipe Dreams Marine LLC under the statutory authority of FAR 13.106-1(b)(1), "Soliciting from a single source" or FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements." The purpose of this contract is to renew the canvas awnings on the Winslow Gressnier during its scheduled inport period.

Sole Source Justification The decision to procure these services on a sole-source basis is driven by the highly customized nature of the equipment and the lack of existing data rights.

The awnings delivered with the Fast Response Cutters (FRCs) are Contractor-furnished from Pipe Dreams.

The design of these awnings is intricate, requiring highly precise measurements for proper installation and usage.

Furthermore, there are significant design variations from boat-to-boat, particularly from FRCs 1140 and onward.

From a contracting perspective, the technical details required to perform this work necessitate utilizing a single responsible offeror due to the following factors: Lack of Data Rights: The Government does not own the data rights required to compete this requirement openly.

Substantial Duplication of Cost: The work is of such complexity that the requirement cannot be reverse-engineered without a substantial duplication of cost to the Government.

It is estimated that reverse engineering efforts, compounded by a steep learning curve for a new offeror, would effectively double the price compared to utilizing the original equipment manufacturer, Pipe Dreams.
