Subject: PR #12461398 for Procurement of Maintenance and Repair Services for Leica Microsystems Medical Devices Reference: RFO 12.102(a) “Restricting Competition” 1.) The purpose of this memorandum is to document the Contracting Officer’s decision that only one source is reasonably available to satisfy this requirement.
2.) The following determination is based on the extensive training, knowledge and market research conducted by Walter Reed National Military Medical Center (WRNMMC) medical training personnel and the independent market research performed by the Contract Analyst and Contracting Officer.
Leica Microsystems Inc is the only company capable of providing the required expertise, knowledge, and turn around time necessary to maintain the three Leica Cryostat devices at Walter Reed National Military Medical Center without voiding the warranty.
Leica Microsystems does not have any authorized third-party maintenance providers and explicitly states that any third party intervention voids liability and warranty.
3.) Leica Microsystems, Inc. (CAGE Code 2F735), has been identified as the sole source awardee under the relevant NAICS code (811210) and is the sole provider of the required services.
4.) I hereby determine that only one source, Leica Microsystems Inc. is reasonably available to satisfy this requirement, and this procurement is in the best interest of the Government.
