INTRODUCTION THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-NAME). The Indian Health Service (IHS), Navajo Area Indian Health Service, Shiprock Service Unit, intends to negotiate and award a contract without providing for full and open competition to: Frontier /Navajo Communications NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE The intended procurement is classified under NAICS code 517111 (Wired Telecommunications Carriers) with a Size Standard of 1,500 employees. REGULATORY AUTHORITY The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Circular (FAC) This acquisition is conducted under the procedures prescribed in FAR Part 12 — Acquisition of Commercial Products and Commercial Services, at an amount estimated at or below the Simplified Acquisition Threshold including the base year and all four option years. STATUTORY AUTHORITY This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Subpart 6.3 — Other Than Full and Open Competition, FAR 6.302-1 (Only One Responsible Source), and 41 U.S.C. 3304(a)(1). A Justification and Approval (J&A) for Other Than Full and Open Competition and an approved Buy Indian Act Deviation Determination pursuant to HHSAR 326.603-3 have been completed and are maintained in the contract file.
