PRE-SOLICITATION NOTICE OF INTENT TO SOLE SOURCE Department of Veterans Affairs (VA) Network Contracting Office (NCO 21) intends to award a sole source, firm fixed price contract to MagVenture, Inc. for MagPro R30 Transcranial Magnetic Stimulation & Applicable Accessories. The procurement is on behalf of the Department of Veterans Affairs, Veterans Health Administration, Regional Procurement Office West (RPOW), Network Contracting Office (NCO) 21, on behalf of Southern Nevada Health Care System. Based on the market research conducted, the MagPro R30 TMS System is the only TMS system found to be FDA approved for the treatment of Pain (stimulation of peripheral nerves), Major Depressive Disorder (MDD), MDD with Anxiety, MDD as an adjunct treatment for adolescents aged 15-21, and adjunct treatment of obsessive-compulsive disorder. Other TMS systems are capable of treating one or two of these conditions, however, the MagPro R30 is the only system that is capable of treating all five conditions with the purchase of a single machine. There are no viable authorized distributors and/or resellers for the MagPro R30 TMS system, with the exception of the Original Equipment Manufacturer (OEM) MAGVENTURE, INC. (LKRCLUTVJTK8). The specific items required are attached. VA s Gray Market Items terms and conditions apply pursuant to VAAR 852.212-71 Gray Market Items and VAAR 852.212-72 Gray Market and Counterfeit Items. As a result, vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the items identified to be eligible for participation with this acquisition.
