SOLE SOURCE PROCUREMENT- The proposed contract action is for the supplies or services for which the Government intends to solicit and negotiate with one source only , Keysight Technologies, Inc. of Colorado Springs, Colorado, Cage Number 7ZXR5, under the authority of FAR 12.201-1 for Commercial services using simplified procedures. This is being solicited on a sole source only basis because Keysight retains exclusive proprietary rights to the specialized technical data, diagnostic software, engineering drawings, and internal schematics required to accurately calibrate, troubleshoot, and repair both the N5183B MXG Microwave Analog Signal Generator and the E8362B Vector Network Analyzer. The restriction of this acquisition to Keysight Technologies is further necessitated by the existence of exclusive proprietary licensing agreements and intellectual property rights over the diagnostic software, firmware, and calibration systems of the N5183B and E8362B assets. Keysight has not authorized or licensed any third-party commercial vendors to access, modify, or utilize their proprietary calibration software suites, internal source codes, or specialized firmware.
