SOLE SOURCE PROCUREMENT- The proposed contract action is for the supplies or services for which the Government intends to solicit and negotiate with one source only Teledyne Lecroy Inc. of Chestnut Ridge, New York, Cage Code 55716, under the authority of FAR 12.201-1 FOR Commercial items using Simplified Acquisition procedures. This is being solicited on a sole source only basis because Teledyne LeCroy, is the Original Equipment Manufacturer for this Oscilloscope and the only viable procurement path to guarantee the proprietary, tier-one technical support and non-severable software updates required to maintain uninterrupted system certification and mitigate long-term operational risk. Market research and multi-branch engineering evaluations have determined that no other commercial-off-the-shelf asset possesses the requisite technical compatibility to execute necessary pulsing and measurement functions. Introducing an alternate manufacturer's asset would force the Government to incur a substantial, non-recoverable duplication of cost totaling $180,000, which includes $57,600 for proprietary software driver development, $64,800 for engineering modifications and test set correlation, and $57,600 for technician-led validation testing.
