Notice of Intent to Sole Source for Modular Test Bed for Emerging Extraction Technologies In accordance with Revolutionary FAR Overhaul (RFO) Part 12, Acquisition of Commercial Products and Commercial Services, the Department of Energy (DOE), National Energy Technology Laboratory (NETL) intends to negotiate and award a purchase order on a sole source basis to Lithos - Element3 to purchase a plug-and-play modular skid-based test bed to evaluate and accelerate the deployment of emerging mineral extraction technologies because Element3 holds intellectual property patent rights portfolio; offers uniquely designed, "plug-and-play" skid-based test bed solution that directly addresses a significant barrier to entry for innovators in emerging mineral extraction technologies and offers significant operational benefits that streamline the evaluation process for critical mineral extraction technologies; and possesses a unique technical capability that consists of operational knowledge, field-validated design templates, and process performance data derived from continuous operation of a substantially similar skid system currently in operation. The anticipated period of performance for this requirement is delivery 24 weeks after award. This is considered a sole source to Element3 because, to the best of the NETL’s knowledge, based on market research conducted Element3 is the only known source that can provide this type of service.
